Simpleton Real Estate: The Case of the Hotheaded Broker. D'OH!

Yesterday, I was doing something that had nothing to do with real estate - so I thought. For some inexplicableReal estate in the People's Court reason, I turned on The People's Court. My parents and I used to love it with Judge Wapner; Judge Marilyn actually annoys me, and I miss Rusty the Bailiff. And why do these women judges use their first names? Judge Marilyn or Judge Judy sounds like preschool names, while Judge Wapner sounds dignified and commands respect. But I digress.

Interestingly enough, the plaintiff for yesterday's case was none other than a broker from a New York City real estate agency, suing a client for not paying commission.

Naturally, I was interested. Even though this is Hawley - Lake Wallenpaupack in the Poconos, and not the "big city," I have come across a few people who certainly want a real estate agent, until it's time to actually pay them. Ahhem. Sorry. Save that soapbox for a different day...

ANYWAY....it turned out the broker had an exclusive-right-to-rent listing agreement with the client he was suing. The client had a Cape Cod home with a finished basement. He wanted to rent the main house to a tenant, while he lived in the basement.

Anyway, the agency did bring a willing tenant...but who could not pay the agreed upon price...d'oh. After this, the agency did not bring any other prospective tenants by. The client grew impatient and found his own tenant. Since he found his own tenant, he did not want to pay commission.

My first thought was "You signed an EXCLUSIVE RIGHT TO RENT!" (More on "Exclusive Right To" contracts in the future...)

So, initially, I began to root for the broker. Initially...

The broker looked so polished. I could see his REALTOR lapel pin catching the studio lights (I noticed this simply because I'm an agent, with my own REALTOR pin stashed somewhere in my house; your average Joe probably wouldn't have recognized the pin...) He looked very cool, professional, confident, and in charge; ready to walk away with his commission...but he wanted $4400.

Huh? The rent was $2200. I'm assuming that the fee was 1 month's rent. So where did he get this other $2200 from?

"It's a two unit building," the broker states.

After much hemming and hawing, it turns out that the client did not contract with them for two units. Only one. The contract, according to what was presented, clearly excluded the basement. Thus, the real estate agency was contracted to rent one unit...the main part of the house. Not the basement.

D'oh.

Then, it turns out that client decided to live in the vacant upstairs part of the house - while he "temporarily" rented his basement for a short term. There was nothing in the contract stating that he as the owner could not LIVE in the upstairs unit while the broker found a tenant. What he did with the basement was his own business...d'oh.

So, I started out thinking the client didn't understand the way an exclusive right to rent contract works. Turns out, it was the broker who didn't understand his own contract.

The broker didn't know that the contract was only for one unit. He didn't know that the owner was living in the upstairs unit, not a tenant that the landlord found. He also didn't realize that the landlord was actually still under contract with him, waiting for him to find him a tenant; he was not in breach of contract! He was still waiting for the agency to bring him a tenant! He had NO CASE! D'OH!

read your real estate contractRather than actually use his noggin', (and read the contract!) the broker took his client to court and made a complete dolt of himself on national TV. Not only that, but he has now managed to alienate not only this client, but everyone in the guy's peer group (SOI). And any local people watching Judge Marilyn make mincemeat of him.

One has to wonder if this case was picked to be an episode specifically to make idiots of real estate agents.

But, it never would have happened if the agent & broker had taken some time to chill, and...maybe...re-read the contract, and perhaps...investigate more thoroughly before taking someone to court.

A real estate agent should be able to depend on his or her broker to sort things out when they get out of whack. I have asked my broker to look things over for me - because let's face it...we all have our moments when we need a different pair of eyes to look at a situation and offer a fresh perspective. Sometimes, a situation requires a third party to step in and smooth over any hiccups that may surface.

Litigation should be reserved solely as an ultimate last resort, after all other options are exhausted. When communication with a client doesn't work, then call in your broker - you need one you can trust to be objective and not be a hot-head.

VERY Important Disclaimer: I realize that this episode could very well have been skewed in such a way as to make the broker look like a moron when he was actually in the right and truly deserves $4400 commission. Maybe the "temporary tenants" his client found were actually "permanents" who did initially move in upstairs, and this landlord consulted a savvy lawyer who advised him on how to win this case. (boot the tenants, move upstairs, and claim the tenants lived in the basement...) Still doesn't explain the fact that the broker clearly thought he was entitled to rent for two units when the contract was only for one... Not having seen the contract, and judging solely by the evidence shown on TV, I don't know for sure. This blog was written on the story as it was presented on TV.

Wayne County: A Pennsylvania Home in the Country

If you are looking for "off the beaten path", this is just the home for you. If you are looking for quiet surroundings, pastoral scenery, and the soothing sound of rushing water nearby, you can stop your search.

ACTUALLY, you'll need me to help you find something else, because this home is now SOLD! 

This is God's Country. It's secluded - without leaving you isolated. Believe it or not, it's within a 15 to 20 minute drive of everything you could need (to some of you city dwellers, with a Walgreen's and Wal*Mart around every corner, 15 to 20 minutes seems long, but it really is not. You are in the country now!)

For fishing enthusiasts, nearby you will find White Oak Pond, a 175 acre lake, which, according to the PA Fish Commission, is home to several species of fish: largemouth bass, chain pickerel, bluegill, pumpkinseed, black crappie, brown and yellow bullhead, and yellow perch.

Another nearby pond is Long Pond (also known as Alden Pond) - which has traditionally been stocked for winter fishing.

15 minutes or so will take you to Honesdale (the county seat for Wayne County, and the biggest town in the county as well), where you will find shopping, Home Depot, movies, fine dining and fast food, a full service hospital, dentists, family doctors, specialized health care, and lots of small town charm.

Go 15 minutes in the other direction and you can hit the slopes at Elk Mountain Ski Resort, one of the leading ski facilities in the area. In the Waymart Boro, you will find more health care services and some other necessities. Scranton & Dickson City PA is just a little further out (roughly 40 minutes or less) and has absolutely everything you could want - there are two malls (Steamtown and Viewmont) with stores like Macy's and Old Navy...in Dickson City you will find Target, Home Depot, and Lowes...tons of national chain restaurants. My favorite movie house is the Cinemark by Montage..(and of course, there's Montage Mountain for skiing as well..)

Many of my clients who initially are looking for a home in the Lake Wallenpaupack area are sometimes surprised at how close together many of the homes are. This very well maintained bi-level home on Creek Drive in Waymart (Mount Pleasant Township, just past Prompton & Aldenville) is perfect for those who are looking for an affordable home with a large yard and lots of space. With about 2 acres of land, you can do a lot of things - plant a garden, do some decorative landscaping, swim in the pool, romp in the grass with kids or pets...or just sit on the deck and enjoy the view.

Across the street, the Lackawaxen River (West Branch) babbles on toward its terminus nearly 40 miles away in Lackawaxen, PA - the last time I was at this property I stood for about ten minutes listening to nothing but the sound of the river. No distracting traffic, no "city sounds." It was almost like a mini-vacation.

Wallenpaupack Lake Estates Community Info

Wallenpaupack Lake Estates MapWallenpaupack Lake Estates is a planned development on Lake Wallenpaupack.

Located along the shore of 5,700 acre Lake Wallenpaupack, Wallenpaupack Lake Estates (WLE) is an amenity filled community in Wayne County, in Northeast PA.

WLE came into being in the early 1970's. The Wallenpaupack Lake Estates Property Owner Association was incorporated in 1973, and the community continued to grow and add amenities throughout the next several years.

Approximately 1200 or so homes make up this thriving Wayne County community.  There are new construction homes available as well as lovely pre-existing homes available for purchase.  Vacant lots, though not as numerous as in times past, are also available for those who would like to build their Pocono Mountain lake house in WLE.   

Wallenpaupack Lake Estates as you see it today is truly the fruit of many years of work, pooling of resources, and much teamwork and cooperation by the property owners.

Adult Lodge: As the name suggests, this lodge is a gathering place for adults (21 and older.) No, it is not a place for naughty shenanigans! Features of the Adult Lodge include a pool table, shuffleboard, TV, etc. Arrangements for use must be made with the Main Office. Located near the Rockledge Pool Complex.

Rockledge Pool Complex features a gorgeous outdoor swimming pool situated along a stunning rock wall. Residents also enjoy bocci, shuffleboard, volleyball courts, a picnic area and a snack bar.

Beaver Lake Pool Complex has a regulation size pool, picnic area, tennis courts (reservation required), and snack bar.

Craft Shop: This seasonal shop is run by volunteers and offers items crafted by WLE residents and WLE branded clothing.

Deer Lake and Beaver Lake: Each offer a swimming beach, boating and fishing facilities. These lakes are non-powerboat and are perfect for paddle boats, canoes, kayaks, and just lazing about on a warm summer day.

Game Courts: Play tennis, basketball, handball, horseshoes; roller blading is also available.

Main Clubhouse: Fully equipped, open for WLE Association and Recreation events. Take a dip in the indoor pool!

Also noted on the Amenity Map is a skateboard park, ballfield, and campgrounds. Wallenpaupack Lake Estates truly offers something for everyone.

Lake Wallenpaupack New Construction: Not Necessarily Better!

New construction homes seem to draw buyers in like ants to a picnic. Many folks seem to think that by purchasing a new construction home that they will be free from headaches and hassles typically associated with home ownership. That may be true - but let's not forget that new construction homes have problems too.

One couple I know have a new construction home, and while they didn't expect everything to be perfect, they certainly didn't expect the builder to take several months to fix a leaky faucet in the bathroom.  Settling cracks can appear and will need to be repaired; there may be other hidden issues with less than stellar workmanship that may crop up.

Let's face it: owning your own home, buying new or pre-existing, means you will need to have repairs done, sometimes sooner, sometimes later....but it's going to happen.

That's a great deal - especially if you're looking at an expensive replacement or repair.

Yes, new construction homes are nice, but they're not necessarily easier to own nor are they always the best deal. Don't let this fantastic home get by you because it's not "new."

Sneaky Staging Tactics? Hogwash!

One of the biggest trends in real estate today is home staging.  I have seen staged homes while showing properties in my market (Lake Wallenpaupack, the Poconos, Pike County, and Wayne County in northeast PA.)  Staging can certainly be an excellent tool to help buyers envision themselves at home in a particular house.

There have been some articles written lately warning buyers about "seeing through the veil of staging."  Supposedly, staging can mask or hide defects in a home, deceiving buyers.  Some of these authors actually go so far as to tell buyers to be WARY of a staged home, because they could be "hiding" something.

To that - I say "Hogwash!"  If the buyer is being represented by a buyer's agent of any quality, that agent will strongly recommend a thorough inspection of the property - both by the buyers themselves AND by qualified home inspection professionals.  Buyers and their agents need to perform their due diligence when purchasing a home - caveat emptor and all that. 

To purchase a home because it looks "pretty", without looking beneath the surface is ridiculous, and frankly, as a buyer I would be offended by the insinuation that staging alone could dupe me into buying a stinker of a home, simply because it had pretty drapes or interesting art on the walls.

Staging is an excellent way to help people see how to maximize or more efficiently use space - perhaps the success of a smaller living room set or dining room table never occured to them until they saw that "cute cozy cottage" staged with streamlined furnishings designed to fit the space.  Or maybe certain color schemes never seemed appealing until seen on the walls of that formal sitting room (I for one always turned my nose up at dark rich colors like pumpkin and mocha until I walked through a few model homes.)

So are these anti-staging gurus going to caution against professional quality photographs, too?  Will wide angle photographs fool buyers into thinking they are buying a home with 2,000 more square feet than is actually there?  Of course not.

One of the homes I recently sold did not interest the buyer until I sent him photos AGAIN, after the home was staged.  Once he saw the furniture placement and the way the home could be warmed up with the right furnishings and accent pieces, he wanted to come see it.  He and his wife were very impressed with the home.  He came back for a second look, this time taking more time to look "behind the scenes" and see beyond the lovely dining table and window treatments.  We walked the property, we investigated neighboring property.  He made an offer, the seller accepted...and then we had the home inspection.  The home inspector couldn't have cared less about the decor; he found some minor issues that needed to be addressed.  These were promptly taken care of.

 

So, what is deceptive about this?

BEFORE:  Plain Jane empty room.  Blah!   AFTER:  Warm and inviting!

Of course, wide angle photography helped, but the real beauty is in the staging.  This didn't conceal, but instead, it turned a cold and uninteresting space into a warm home to come home to. 

We closed the other day with a happy buyer, a happy seller, and a very happy me.  And I thank the seller's wife for taking the time to stage the property - because that is what encouraged the interest.  I merely took new pictures to send to my buyer.

That's what staging is all about - it's not meant to deceive, but to help buyers see potential.

Sleigh Bells Ring...Are Ya Listenin'...?

I know that not everyone rejoices at the sight of the cold, white, fluff blanketing everything terrestrial. Some cringe, considering it a four-letter word most foul, while hunkering down woolen-clad, with a comforting supply of hot chocolate and chicken soup in the pantry. There are those with no desire to ski, sled, skate, make impressions of heavenly beings or build rotund snow-people.

Thankfully, lyricist Dick Smith (a Honesdale PA native) found it wonderful, and his fond thoughts on the matter are forever preserved in the song Winter Wonderland. Local legend, bolstered by the opinion of the late Mr. Smith's sister, has it that Mr. Smith wrote this seasonal standard while remembering Honesdale's snow-covered Central Park.

Incidentally, someone with a very overactive imagination and a curious thought process feels that Winter Wonderland is not about light-hearted young people frolicking around making snow-parsons and holding hands; no. No, this song is about teen age rebellion and illicit behavior. What can I say? It takes all kinds...and we're all entitled to our own opinion.

Regardless of what story Mr. Smith was telling with his song, the fact remains that Wayne County truly is a Wonderland, whatever the season. When looking for a Norman Rockwell experience, Honesdale will fit the bill perfectly. The county seat for Wayne County, Honesdale offers everything you expect from a small country town...with the amenities the contemporary world has come to depend on. Step back in time while keeping your feet firmly planted in the present.

Stroll up and down both Church and Main Streets and you will be delighted with the Victorian character. Find all sorts of locally owned and operated shops, diners, and restaurants offering unique gifts, wares, and delicious food;Rural Wayne County PA Life take a break from Wal*Mart & McDonald's. You'll be glad you did.

Perhaps, that while this small town is a great place to visit and shop, it is still too busy for you to take up permanent residence. Maybe you are looking for a more rural Utopia - farms and woodlands are more your style. Well, this can be had only minutes from town!

One such area is Mt. Pleasant Township - a paradise of rolling hills, breathtaking views, and friendly cows by the roadside, welcoming you to the country life. Overnight SNOW-sation

This show was created a couple of weeks ago and was sent out to my friends and clients in my email circle. I would like to share it here, too, with my blog readers and friends!

Living in Northeast PA, I've learned to become accustomed to the arrival of snow at odd times. One year, we had almost two inches come down the week before Halloween; my husband remembers shoveling his car out sometime in early May. Last year, we never got our first significant snow storm until Valentine's Day.

This year, we had a long, warm Indian Summer - no real autumn to speak of. The leaves never really turned the usual brilliant array of colors that Pike County (and of course, Wayne County) is almost famous for. My apple tree however, was loaded with beautiful red-cheeked globes decorating the tree. So beautiful were these apples that I was compelled to take a few pictures, along with some nearby red maple leaves.

Little did I know that the next morning, all would be covered with the first snow of the season. A little over a week ago, the temps were in the 70's. Then, snow. I had to take more pictures.

I hope you enjoy the show - and you can see how beautiful Pike and Wayne County PA is - in any season.

Wallenpaupack Blogger Returns!

Well, it's been many, many days since I've had the time to write a new blog. I have all sorts of topics to post on - about Wallenpaupack lakefronts, about the Lake Wallenpaupack real estate market in general, about new listings and about homes going under contract. I'll be working on these new blogs in the coming days.

I have been very busy in the business of real estate. Some will say "Doom, doom! The market is dead!" We at WEICHERT, REALTORS - Paupack Group don't believe it! Our office has been busy as little bees, working hard for our sellers and buyers.

Kids in the snowJust before Thanksgiving, we enjoyed our first snowstorm; it was a Monday morning and the kids were delighted to be excused from school for the day.

I however, was NOT excused; I had an appointment to meet my buyer at the home he is purchasing. The home inspection was scheduled for that morning and I knew that my client had made a long journey the evening before to be there for the inspection.

The kids tagged along and played in the yard while I met with my client and the home inspector. It was a winter wonderland in Paupackan Lake Estates that day!

This lovely stream is just around the corner from my client's new house; it babbles and gurgles just like the stereotypical "babbling brook" and I could not resist taking a snapshot of it in all this wintry, snowy glory as it bubbled down the white hillside toward Paupackan Lake.

After meeting my client, I drove out past Prompton in Wayne County, to Waymart - to measure rooms and take pictures of my new listing (the subject of an upcoming blog.) The trip took a long time, as I had to stop many times to take pictures of the beauty of winter in Wayne County, PA. If you'd like to see more, click below on my album from that day:
